Arizona NOT a Daubert State
On July 29, 2010 Arizona law became effective changing the way fire investigators will be considered when testifying as an expert in Arizona courts. However, the Arizona Supreme Court has determined that the Daubert law is not legal. Much push back came from the judges within the state who felt they would lose control of being the gate keepers for experts testifying in court. Frye is still the standard in Arizona with some hybrid additions yet to be seen.
